Gossamer HQ Inc. values your privacy in your personal information. This Privacy Policy explains what information Gossamer HQ Inc. (“Gossamer,” “we” or “us”) collects about you and why and what we may do with that information. This Privacy Policy applies to information we collect when you access or use our website (the “Site”) or when you otherwise interact with us, such as through our products or services (the “Services”). We included some commentary on the terms for each section below to provide context and plain language; however, these commentaries do not form part of the legal terms.

This Privacy Policy is incorporated into Gossamer Terms of Service and applies to the information obtained by us through your use of our Site. You can find the definitions for capitalized terms used in this Privacy Policy that are not otherwise defined in this Privacy Policy in the Terms of Service.

As Gossamer evolves, we may need to update this Privacy Policy to keep in pace with changes with our Site, our business and laws applicable to us and you. We will, however, always maintain our commitment to respect your privacy. We will post any revisions to this Privacy Policy, in an easy to find area of our Site, so we recommend that you periodically check back here to stay informed of any changes. We will ask for your consent to any material changes if required by applicable law; in other cases, please note that your continued use of our Site after any change means that you agree with, and consent to be bound by, the new Privacy Policy. - Identification and Contact Information: We collect your username, email address and contact preferences.
- Financial Information: We collect payment information through third party payment processors.
- Communication Information: We collect information included in your communications with us.
- We may also collect any other information you choose to provide.
- We automatically collect the following categories of information:
- Internet Activity Information: We collect information about how you access our Site, including data about the device and network you use, such as your hardware model, operating system version, mobile network, IP address, unique device identifiers, and browser type. We also collect information about your activity on our Site and interaction with our communications, such as access times, pages viewed, links clicked, and the page you visited before navigating to our Site.

- Vendors: We disclose information to vendors, service providers, contractors and consultants that need this information to provide services to us, such as companies that assist us with web hosting, payment processing, customer service, analytics, and marketing and advertising.
- Professional Advisors: We disclose information to our lawyers and other professional advisors where necessary to obtain advice or otherwise protect and manage our business interests.
- Legal Authorities: We may disclose information to legal authorities and others for the protection and compliance purposes, including if we believe that disclosure is in accordance with, or required by, any applicable law or legal process, including lawful requests by public authorities to meet national security or law enforcement requirements and if we believe that your actions are inconsistent with our user agreements or policies, if we believe that you have violated the law, or if we believe it is necessary to protect the rights, property, and safety of Gossamer, our users, the public, or others.
- Corporate Transactions: We reserve the right to disclose information in connection with, or during negotiations of certain corporate transactions, including the merger, sale of company assets, financing, or acquisition of all or a portion of our business by another company.
- Affiliates: We reserve the right to disclose information between and among Gossamer and any current or future parents, affiliates, subsidiaries, and other companies under common control and ownership.
- Consent: We may disclose information when we have your consent or you direct us to do so.
- We also disclose de-identified information that cannot reasonably be used to identify you.
- We do not collect information from children who are not lawfully permitted to use Gossamer pursuant to the Children’s Online Privacy Protection Act.
Gossamer does not knowingly collect personal information from children under 13 years of age without parental consent. If we learn that we have inadvertently obtained information in violation of applicable laws prohibiting collection of information from children under 13 years of age without such consent, we will promptly delete it. If you are a parent or guardian and believe that your child has provided personal information to us without your consent, you may contact us at hi@gossamer.co, and we will work to delete such information.
- We may contact you from time to time, but we will not spam you.
From time to time, we may contact you with information about product announcements, service offerings that we think may be beneficial to you, software updates and special offers. We consider your acceptance of this Privacy Policy as your acceptance of our offer to send you these communications. You may opt out of such communications at any time by following the opt-out instructions provided in emails or by logging into your Gossamer account via our Site and changing your contact preferences. You will continue to receive essential our Site-related and account-related information, even if you unsubscribe from promotional emails.
- When you provide data or User Content to Gossamer, it is stored in the United States.
If you are located outside the United States, the information that we collect from you may be transferred to, and stored and processed at, a destination in the United States. By submitting information, you agree to this transfer, storing or processing. We will take all steps reasonably necessary to ensure that your information is treated securely and in accordance with this Privacy Policy.
- Gossamer is committed to protecting your information.
Gossamer takes reasonable precautions to protect your information and User Content. We use industry standard encryption to protect your data in transit. This is commonly referred to as transport layer security (“TLS”) or secure socket layer (“SSL”) technology. However, internet data transmissions, cannot be guaranteed to be 100% secure, and as a result, we cannot ensure the security of information during its transmission between you and us; accordingly, you acknowledge that you do so at your own risk.
If Gossamer learns of a security system breach, we may attempt to notify you and provide information on protective steps, if available, through the email address that you have provided to us or by posting a notice on our web site and/or via other communication platforms. Depending on where you live, you may have a legal right to receive such notices in writing. All payment transactions, including for your account and payments you receive from customers are conducted through our PCI-compliant and secure payment solutions provider, Shopify Pay. - If you decide to stop using Gossamer or we deactivate your account, the information associated with your account will no longer be available.
You can stop using Gossamer at any time. If you or we deactivate your account, your account and all information associated with your account will be deleted unless otherwise required by applicable law.
